Question is :
Are we 'overpayed', and should we refund money?
To whom? Medicare or patient?
What if Medicare decides that this was a worker's comp issue and recoups all their money...if we have already paid the patient how do we get our money back?

One issue you may have with the answers that you get is that there are several ways to handle this, apparently, some of us would handle it differently than others.

First I would make every attempt to call, fax or write to the comp carrier. then........
I would refund the worker's comp carrier. I would attach a cover letter explaining the details, a copy of the comp eob and the mcare eob and a check.
No... you should not keep the funds and yes you should adjust the medicare disallowed amount.

That's how I would handle this.
